The petitioner seeks bail in Kalyanpur P.S. Case No. 210 of 2013, instituted for the offence under Section 394 of the Indian Penal Code.
Counsel for the petitioner submits that there is no specific allegation against this petitioner. Petitioner is alleged to have been identified at the place of occurrence by Yadolal Rai and Chintu Kumar. The informant has not taken the name of this petitioner in the written report. No Test Identification Parade has been held. Counsel for the petitioner submits that co-accused Brijesh Rai has already been granted bail by coordinate Bench of this Court vide order dated 3.3.2015 passed in Cr. Misc. 49487 of 2014.
Patna High Court Cr.Misc. No.76067 of 2018(3) dt.21-01-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 210 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
