1. Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in Complaint Case No.533 of 2021 registered for the offences punishable under Sections 323, 325, 379, 498(A) and 34 of the Indian Penal Code and Sections 3 and 4 of the D. P. Act and thereafter, the learned Sessions Judge, Saran at Chapra takes cognizance under Sections 323, 498(A) and 34 of the I.P.C.

The learned counsel for the petitioner submits that the petitioner, in compliance of the order dated 22.02.2024, did not represent before the Superintendent of Police, Saran at Chapra, but then, is not in a position to furnish any explanation that as to why the representation was not filed before the Superintendent of Police, Saran at Chapra in compliance of the order dated 22.02.2024 by the petitioner.

Learned A.P.P. submits that when the case was taken up on 22.02.2024, a plea was raised by the learned counsel for the petitioner that opposite party no.2 has performed her second marriage with Sunny Kumar and out of the wedlock, a child was also born. It was because of this fact that this Court had directed the Superintendent of Police, Saran at Chapra to get the matter enquired from the S.H.O., Maker Police Station. The learned A.P.P. next submits that it appears that the petitioner, only with a view to seek stay, made a false submission or else he would have represented before the Superintendent of Police, Saran at Chapra for getting the matter enquired.

5. In view of the submissions made by the learned Additional P. P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

6. Accordingly, the prayer of the petitioner for anticipatory bail is rejected.
