2. The petitioner has preferred this application for grant of regular bail in connection with Imamganj P.S. Case No. 53 of 2022, dated 05.04.2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, the informant who is the Branch Manager of Maitya Chaitanya India Micro Finance Private Limited, Imamganj along with his company staff Dipu Kumar and Indradeo Yadav went to Iswatpur for R.P. collection and they collected about Rs. 55610/-. While they were returning to Imamganj, three unknown persons riding on a motorcycle stopped their vehicle and on gun point they looted the whole

Patna High Court CR. MISC. No.42691 of 2025(2) dt.16-07-2025 2/3 collection money along with mobile and SIM cards and they also took the purse, Aadhar card, voter ID card and Rs. 800/- of staff Dipu Kumar.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. and name of petitioner sprung up in the present case due to self-confessional statement of petitioner in Hunterganj P.S. Case No. 52 of 2022. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got 11 criminal antecedents as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 20.03.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Class, Sherghati, Gaya, in connection with Imamganj P.S. Case No. 53 of 2022, on further condition:

No.42691 of 2025(2) dt.16-07-2025 3/3 (i) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
