====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 05-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 8 and 20 of the N.D.P.S. Act. 114 Kg. of ganja was, allegedly, recovered from possession of the petitioner. Petitioner is in custody since 17.12.2016.

The report of the learned trial Judge would reveal that the case is at the stage of prosecution evidence and no prosecution witness has been examined in this case up till now. If the trial would not be concluded within a period of one year from the date of receipt/production of a copy of this order, the petitioner would be entitled to be released on bail on

Patna High Court Cr.Misc. No.58673 of 2017 (4) dt.05-02-2018 2/2 furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with V/NCB/PZU Case No. 09 of 2016 corresponding to NDPS Case No. 08 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

Accordingly, this application stands allowed to the aforesaid extent.
