ANJANA MISHRA ORAL ORDER 19-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.11.2017 in connection with Biraul P.S. Case No.241 of 2015 registered for the offence under Section 302 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner had lodged the F.I.R.. The deceased was his wife. It is submitted that on account of dispute with regard to construction of a Nala, the cousin of the petitioner had attacked his wife, leading to her death.

Diary in the present case was called for, which has since been received.

After perusal of the case diary and the Forensic

Patna High Court Cr.Misc. No.315 of 2018 (3) dt.19-02-2018 2/2 Science report, which indicates the presence of the sulphas in the viscera of the deceased lady and that even in the postmortem report, no external injury has been found on her person, this Court is not inclined to grant regular bail to the petitioner. It is, accordingly, rejected. The trial, however, should be expedited and be concluded within a period of one year. (Anjana Mishra, J) PNM U T
