JUSTICE BIRENDRA KUMAR ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,342,353,379,427,504,506/34 of the Indian Penal Code. It appears that prayer of the petitioner for anticipatory bail was refused on 26.11.2018 with direction to surrender within three weeks.
The petitioner has neither surrendered nor challenged the aforesaid order before the Superior Court. Prayer is for extension of time for surrender. If this Court would have allowed prayer for anticipatory bail, it was understandable that under what
Patna High Court CR. MISC. No.41967 of 2019(2) dt.28-08-2019 2/2 circumstances, the petitioner could not surrender. For surrender, no order of the Court is required. Hence, this application is dismissed in connection with Rajauli P.S.Case No.162 of 2018 pending in the court of learned Chief Judicial Magistrate, Nawada with cost of Rs.5,000/- to be deposited in the Victim Compensation Fund for the reason that petitioner has deliberately interrupted with the precious time of the Court.
Accordingly, this application is dismissed.
