JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-03-2021 Heard Mr. Arun Kumar Arun, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Ekanger Sarai P.S. Case No. 101 of 2020 registered for the offences punishable under Sections 341, 323, 324, 326, 307 and 504 of the Indian Penal Code 1860.
The allegation as per the First Information Report is that the petitioner assaulted the husband of the informant by means of knife near his ribs.
Learned counsel for the petitioner submits that the

No.630 of 2021(2) dt.05-03-2021 2/3 petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case inasmuch as there is land dispute between the parties. Learned counsel further submits that the petitioner was also assaulted by the side of the informant but the First Information Report of the petitioner was not accepted. Learned counsel next submits that the petitioner is in custody since 13.04.2020 and charge sheet has already been submitted in the matter.
Having regard to the submissions made by the parties and taking into consideration the materials on record, the fact that both the parties are co-villagers and there is land dispute between them as well as the petitioner is in custody since 13.4.2020, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa (Nalanda), in connection with Ekanger Sarai P.S. Case No. 101 of 2020.
