JUSTICE PARTHA SARTHY ORAL ORDER 04-04-2022 Heard learned counsel for the parties The petitioner has preferred this application for grant of regular bail in a case registered under sections 457 and 380 of the Indian Penal Code.
As per the prosecution case, the informant found the door of his house broken open and various goods as given in detail in the FIR to be stolen.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The FIR was registered against unknown. The name of the petitioner transpired in course of investigation. The prosecution is falsely relying on the alleged confessional statement of the petitioner made before the police that he had given effect to the occurrence for the purpose of satisfying his need for

It is further submitted that the allegation that some of the stolen articles were recovered from his possession is also false and chargesheet has been submitted in the case. The petitioner is in custody since 24.3.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Hajipur Town P.S. Case no. 332 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Vaishali at Hajipur.
