JUSTICE MADHURESH PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are accused in a case registered for offence under section 307 and other allied sections of the IPC. Counsel for the petitioners submits that in the scuffle between the both sides, the specific allegation is against Ashish Paswan who assaulted with Khanti to Abodh Kumar in which both sides sustained injuries. Prior to the lodging of this case, petitioners are not accused in other case. Petitioners are in custody since 18.10.2017.

In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let all the three petitioners above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount

Patna High Court Cr.Misc. No.734 of 2018 (2) dt.11-01-2018 2/2 each to the satisfaction of the Additional Chief Judicial Magistrate cum Sub judge 16th, Muzazffarpur in Gaighat Police Station Case No. 234 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners.

(b) They will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
