Misc. applications have arisen out of the same occurrence and as such they have been heard together and are being disposed of by passing this common order.

2. Heard learned counsel for the petitioners and learned APP for the State.

3. The petitioners have preferred this application for grant of regular bail in connection with Ramnagar P.S. Case No. 596 of 2024 registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 329(3), 115(2), 109(1),

Patna High Court CR. MISC. No.43812 of 2025(4) dt.15-09-2025 2/3 103(2), 351(2) and 352 of the BNS.

4. According to prosecution case, the informant Mukendra Yadav reported that a dispute over a drain led to the accused assaulting his family members. His brother Pintu Yadav, along with other relatives, sustained injuries, and Pintu Yadav died when he was being taken to the Primary Health Centre. After the death, the accused also attacked the family at the hospital.

5. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to dirty village politics. From a perusal of the F.I.R., it appears that the informant himself is an eyewitness to the incident, which arose out of a dispute regarding drainage. A total of five individuals have been named as accused in the F.I.R.; however, the allegations made against them are general and omnibus in nature, without specific attribution to any individual. Both the petitioners are in custody since 27.12.2024. Learned counsel further submits that other co-accused persons namely Harinder Yadav and Pankaj Kumar have been granted bail by the Co-ordinate Bench of this Court vide order dated 30.07.2025 in Cr. Misc. No. 30578 of 2025 and another accused namely Anita Devi has also been granted bail be the Co-ordinate Bench of this Court vide order dated 15.05.2025 in Cr. Misc. No.

6. Learned A.P.P. appearing on behalf of the State as well as learned counsel for the informant have vehemently opposed the prayer for bail of the petitioners.

7. Keeping in view the aforesaid facts and considering the period under custody, let the petitioners, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champraran in connection with Ramnagar P.S. Case No. 596 of 2024 subject to the following conditions :- (i). Petitioner will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
