2. The accused/petitioner is named in F.I.R. and apprehending his arrest in connection with Raxaul P.S. Case No. 137 of 2025, registered for the offences punishable under Sections 127(2), 318(4), 143, 338, 336(3), 61(2), 3(5) of the BNS and Section 14(1) of Child and Adolescent Labour (Prohibition and Regulation) Act, 1966 and Section 79 of Juvenile Justice Act.
3. As per FIR, the petitioner alongwith other coaccused persons cheated innocent persons on pretext of providing job with M/s DBR/Win Maker.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner was franchiser of the aforesaid company and, therefore, there is no occasion to assure or to make any promise to anyone to secure a job with M/s DBR/Win Maker. It is submitted that during course of investigation, statement under Section 183 of the BNSS of two alleged victims were recorded, which is available under paragraph nos. 76 and 77 of the case diary, where the private complainant/victim even failed to name this petitioner. It is submitted that petitioner found involved in three more criminal cases, where considering the nature of accusation, the petitioner was granted anticipatory bail.
5. Learned APP opposed the prayer of anticipatory bail.

Considering the aforesaid facts and circumstances as the victims while recording their statement under Section 183 of the BNSS, as discussed aforesaid failed to name this petitioner qua his involvement with alleged allegation, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within

No.44571 of 2025(3) dt.26-09-2025 3/3 a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Raxaul at Motihari, East Champaran/concerned Court, where the case is pending in connection with Raxaul P.S. Case No. 137 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./482(2) of the BNSS.
