The petitioner is seeking regular bail in Ara Nawada P.S. Case No. 432 of 2017 registered under Sections 379 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been allegedly caught by public for theft of mobile phone. Learned counsel submits that as per the allegation, four mobile sets with SIMs were recovered from his possession. The petitioner is in custody since 03.10.2017.
Learned A.P.P. representing the State opposed the prayer for bail.
Considering the facts and circumstances, let the petitioner, namely, Narayan Sah, be released on bail on his
Patna High Court Cr.Misc. No.63693 of 2017 (2) dt.11-01-2018 2/2 furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 432 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C. and further conditions that one of the bailors shall be a family member of the petitioner having no criminal antecedent and, in case of repetition of the offences alleged, the petitioner would invite cancellation of bail.
