2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 323, 341, 380, 504, 506, 363, 366 (A), 34 of the Indian Penal Code.
3. It is alleged that all the accused persons including this petitioner came to the house of the informant and assaulted him and his family members and kidnapped the minor granddaughter of the informant aged about 13 years.
4. It is submitted that petitioner is not named in the F.I.R. and his name transpired during course of investigation merely because he happens to be brother-in-law of co-accused Deepak Kumar. The complaint has been lodged after the delay
Patna High Court CR. MISC. No.44882 of 2023(2) dt.11-08-2023 2/2 of 24 days, as such, chances of embellishment and improvisation renders the prosecution case doubtful. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st Benipatti, District - Madhubani in connection with Bisfi (Patauna) P.S. case no . 110 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
