The petitioner claiming to be registered owner of Maruti Dzire VXI bearing Registration No.BR31AG2594, Chassis No.MA3CZF63SKA77530 and Engine No.K12MN2312205, has approached this Court for direction to release of his vehicle. However, during hearing, it was noticed that petitioner being owner of the vehicle was also made accused. On being asked, learned counsel for the petitioner submits that petitioner is taking step for granting bail, meaning

Patna High Court CWJC No.13685 of 2019(2) dt.25-09-2019 2/2 thereby that petitioner has not appeared before the court below till date and as such it is not advisable for this Court to entertain a petition of an accused, who is not abiding law. After noticing this fact, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file fresh writ petition after the petitioner appears before the court below and granted bail. The prayer is allowed. The writ petition stands dismissed as withdrawn with liberty as indicated above.
