The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. As per the prosecution case, despite taking consideration money through cash and cheques, petitioner sold the land in question to some other person.
It is submitted that entire allegation is false and fabricated and petitioner has never executed any agreement to sell or any document in favour of informant. Petitioner never received any money either through cheque or cash from the informant. It is next submitted that there is no single chit of
Patna High Court CR. MISC. No.44717 of 2022(2) dt.05-12-2022 2/2 paper on record which shows that petitioner had taken any money or executed any agreement in favour of informant. As a matter of fact, on 24.02.2021 petitioner had executed registered power of attorney in favour of Brajesh Kumar Singh to look after the land. It is further submitted that the land in question falls in the share of petitioner and the sale deed has been executed in favour of Sahnwaj Ahmad. Petitioner is an advocate aged about 67 years suffering from various ailments. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist (East), Muzaffarpur in connection with Mohammadpur P.S. Case No. 272 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
