JUSTICE ARUN KUMAR ORAL ORDER 07-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bariyarpur PS Case No. 98 of 2017 registered under Sections 341, 342, 307, 34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that the petitioner on the lonely place stopped the motorcycle of the informant and made an attempt to cut his neck by sickle and one another accused shot at him. Learned Counsel for the petitioner submits that the allegation is false and no corresponding injury on the neck has been found, the injury report does not mention dimension of the injury except that from the neck blood was oozing out from the cut injury. No fire arm injury was found on the body of the informant and another coaccused has been admitted to bail. Charge-sheet has been submitted in this case.

Having considered the said facts and circumstances, the petitioner, namely, Mithun Yadav @ Prince Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Munger in connection with Bariyarpur PS Case No. 98 of 2017.
