The petitioner seeks bail in anticipation of his arrest in connection with Rupaspur P.S. Case No. 237 of 2021 instituted for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is the owner of the motorcycle, while liquor has been recovered from the Scorpio vehicle which was also park next to his motorcycle. In view thereof the petitioner has also been sought to be involved in the case.

I have considered the submissions and taking into consideration the aforesaid facts, exfacie case under Section 30(a) of the Act is not made out, I am inclined to allow the

Patna High Court CR. MISC. No.54507 of 2021(2) dt.22-02-2022 2/2 petitioner on bail, in the event of arrest he shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
