The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Jakkanpur P.S. Case no. 429 of 2020, G.R. No. 5574/2020 instituted for the offence under Sections 341, 323, 307, 498A, 504 and 506 of the Indian Penal Code.
As per allegation in the FIR, due to non-fulfillment of demand of dowry informant was tortured in various ways by her husband and his family members including the petitioner. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is dever of the informant and has been falsely implicated in this case. Petitioner is residing separately. Patna High Court CR. MISC. No.39463 of 2020(3) dt.25-10-2021 2/2 granted bail by the learned lower court in A.B.P. No. 5978 of 2020. The husband, namely, Pawan Sao @ Gyan Chandra Prakash against whom there was specific allegation, has already been granted regular bail by this Court.
Learned APP appearing on behalf of the State has opposed the prayer of bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Jakkanpur P.S. Case no. 429 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Class, Patna subject to the conditions as laid down under section 438(2) of the Cr.P.C.
