Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
There is no eye witness of the double murder. However, allegation against the petitioner and several others is of conspiracy, as a result whereof, murder was committed. The conspiracy was due to the fact that there was old land dispute between the parties. In paragraph-18 of the case diary, witness stated before the police that three persons had committed the murder.
Learned counsel for the informant opposed the
Patna High Court Cr.Misc. No.59561 of 2017 (3) dt.11-01-2018 prayer for bail.
Considering the fact that there is no substantial material against the petitioner for refusal of the prayer for bail at this stage.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dariyapur Police Station Case No.62 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
