JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2021 Heard Mr. Satish Kumar Sinha, the learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Mahua P. S. Case No.326 of 2015, instituted for the offences under Sections 392 of the Indian Penal Code.

The petitioner has not been named in the F.I.R. and his implication in this case is only on the basis of confession of one Raju Kumar. Beyond the confession of the arrested accused person, there is no other material against the petitioner to connect him with the offence.

The petitioner was earlier made accused in a case of similar nature, but that was in the Year 2015 and in that case, the petitioner has been granted bail as he was made accused on

Considering the afore-stated facts, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Vaishali at Hajipur in connection with Mahua P. S. Case No.326 of 2015, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
