JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code. As per F.I.R, the informant has alleged that his younger brother Chandan Kumar was in love with Pinki Kumari and on 18.11.2019, the informant got information on mobile that his brother was going to Muzaffarpur to solemnize court marriage with Pinki Kumari. It is further alleged that on 04.01.2020, the informant came to know that all the F.I.R named

Patna High Court CR. MISC. No.44814 of 2022(4) dt.13-03-2023 2/3 accused persons under conspiracy have killed the brother of the informant and threw his dead body at Dhaupra Chaur.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R. There is no eye witness to the occurrence and only on suspicion the petitioner has been roped in the present case. Moreover, F.I.R named accused person has been granted bail by a coordinate Bench of this Court vide order dated 05.08.2022 passed in Cr. Misc. No. 14504 of 2022. The petitioner is languishing in custody since 20.04.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, West, Muzaffarpur in connection
