2. The petitioner seeks regular bail in the present case registered for the offence under Sections 8(c) and 21(b) of the N.D.P.S Act.

3. As per the prosecution case, 23.84 grams of Brown Sugar has been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 24.02.2024 and has clean antecedent.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the recovery of intermittent quantity

Patna High Court CR. MISC. No.49328 of 2024(2) dt.24-07-2024 2/2 from the petitioner and considering the fact that he has clean antecedent, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge if the charge has not already been framed on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Samastipur/concerned Court below in connection with Samastipur Muffasil P.S. Case No. 72 of 2024 subject to condition that:- 7(i). The petitioner will mark his attendance at the Samastipur Muffasil Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

7(ii) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
