The petitioner seeks bail in Special Case No. 7774 of 2017 arising out of Salimpur P.S. Case No. 50 of 2017 registered for the offence punishable under Section 30(Ka)(Ga) (Gh) of the Bihar Excise Prohibition Act-2016. Allegation against the petitioner is that he is the owner of Bolero Pick-up van from which 306 litres of illicit foreign liquor was seized by the police.

It has been submitted on behalf of the petitioner that the petitioner was not present at the place of occurrence and only because he is the owner of the vehicle from which illicit liquor was recovered, has been made accused in this case. Petitioner has got no criminal antecedent and is in custody since

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Special Case No. 7774 of 2017 arising out of Salimpur P.S. Case No. 50 of 2017.
