JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This application, for grant of anticipatory bail, arises out of Bibhutipur P.S. Case No. 225 of 2017, disclosing offences under Sections 341, 323, 307/34 of the Indian Penal, Code., Allegation as per F.I.R. is that while petitioner and his father were at their home, petitioners and others came and there is allegation against petitioner no. 1 that he caught hold the informant and petitioner no. 2 assaulted him by means of lathi, causing injury to him.
Submission of learned counsel for the petitioners is that there was some dispute with respect to money transaction between the parties, for which, this false and concocted case has

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Rosara, Samastipur, in connection with Bibhutipur P.S. Case No. 225 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
