The petitioner seeks regular bail in connection with Pachrukhi P.S. Case No. 250 of 2017 for the offences punishable under Sections 272/273/308/420 of the Indian Penal Code and Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 0.9 liters of illicit liquor from the pocket of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that barring one case in which he is on bail, the petitioner has a fair antecedent. It is stated that the petitioner is in custody since 6.11.2017.
Considering the nature of accusation and the period
Patna High Court Cr.Misc. No.743 of 2018 (2) dt.18-01-2018 2/2 of custody already undergone, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II, Siwan in connection with Pachrukhi P.S. Case No. 250 of 2017. It is further directed that the petitioner shall appear before the learned trial Court on each and every date fixed, failing which the privilege of regular bail shall be cancelled and he will be taken into custody forthwith.
