The petitioner is in custody since 04.12.2016 in connection with S.Tr. No. 69 of 2017 arising out of Lakhisarai (Ramgadh Chowk) P.S. Case No. 585 of 2016 for the offence registered under Sections 364, 34, 302, 201 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that only on account of the fact that there was quarrel between the petitioner and one Sukar Ram, husband of the informant 15to 20 days before the alleged date of occurrence, the petitioner's name has been brought in on suspicion. It is further submitted that there is delay in lodging the first information report which also stands unexplained. It is further submitted that the entire allegation is based on conjecture and surmises and co-accused Mukesh Thakur,
Patna High Court Cr.Misc. No.58802 of 2017 (2) dt.13-12-2017 2/2 who is the husband of the petitioner, has also been extended the privilege of regular bail in Cr. Misc. No. 49979 of 2017 vide order dated 09.11.2017.
Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with S.Tr. No. 69 of 2017 arising out of Lakhisarai (Ramgadh Chowk) P.S. Case No. 585 of 2016. (Anjana Mishra, J) Jagdish/- U T
