JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner is seeking regular bail in Bhabua P.S. Case No. 673 of 2017 registered under Sections 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that as per the allegation, the petitioner was one of the members, who had assembled at the place of occurrence for making preparation or plan to commit an offence. He submits that no fire arm has been recovered from possession of the petitioner and the petitioner has got no criminal history save and except one case which is stated in Paragraph 3 of the application in which the matter has been compromised between the parties.

Learned A.P.P. representing the State opposed the

Patna High Court Cr.Misc. No.63696 of 2017 (2) dt.11-01-2018 2/2 prayer for bail.

Considering the facts and circumstances, let the petitioner, namely, Sanoj Yadav @ Patru, be released on bail on his furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua (Kaimur) in connection with Bhabua P.S. Case No. 673 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
