====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-09-2021 Heard Mr. Vikram Deo Singh, the learned Advocate for the petitioner and Ms. Sucheta Yadav, the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Sanjhauli P. S. Case No.149 of 2019, instituted for the offences under Sections 366(A) and 34 of the Indian Penal Code.

Though the accusation against the petitioner is of having abducted the minor daughter of the informant for the purpose of marriage but the learned Advocate for the petitioner has submitted that the victim is a major who of her own volition decided to marry the petitioner.

In support of the aforesaid contention, the learned Advocate for the petitioner has drawn the attention of this Court

Patna High Court CR. MISC. No.41103 of 2020(3) dt.21-09-2021 2/2 to Para-41 of the case diary which indicates that the Investigating Officer verified the certificate granted by the Bihar School Examination Board where the date of birth of the victim is stated to be 25.09.2001.

Considering the aforesaid submission of the petitioner, he was granted provisional bail by order dated 24.07.2021.

The learned Advocate for the petitioner has submitted that the case has been lodged only because the relationship of the victim with the petitioner is not liked by her parents. Considering the fact that the victim is a major who of her own choice has decided to marry the petitioner, the provisional bail granted to him is hereby confirmed. The petitioner shall remain on the same bail bonds. The application stands allowed.
