JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bodh Gaya P.S.Case No. 280 of 2017 registered under Sections 302, 364, 365, 120B and 34 of the Indian penal Code. Allegation in brief is that informant's brother went to meet somebody else but did not return back and his dead body was found later on.

It is submitted that petitioner is not named in the FIR and except disclosure of his name by one Ranjan Kumar Yadav in his confessional statement that petitioner shot at the deceased, there is no other material and he has been in custody since 16.05.2017 having no criminal antecedent and the police has submitted charge sheet in this case and co-accused Haridwar Mishra has been admitted to bail by a co-ordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.57532 of 2017 (3) dt.18-01-2018 2/2 dated 09.10.2017 passed in Cr. Misc. No. 40765 of 2017. Having considered the aforesaid facts and circumstances, the petitioner, namely, Ram Saran Sao @ Saran Sao is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Bodh Gaya P.S. Case No. 280 of 2017, with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical emergency, his bail bond shall be liable to be cancelled.
