2. At the outset, learned counsel for the petitioners seeks permission to withdraw this application on behalf of petitioner no. 1 namely, Md. Latif Ansari @ latif Ansari @ Abdul Latif.

3. The application is dismissed as withdrawn with regard to petitioner no. 1 and now it is restricted to petitioner no. 2 namely, Rashida Khatoon.

4. The petitioner no. 2 seeks bail in connection with Vaishali P.S. Case No. 59 of 2025 registered for the offence punishable under Sections 103, 238 and 3(5) of the Bharatiya

Patna High Court CR. MISC. No.42951 of 2025(2) dt.16-07-2025 2/2 Nyaya Sanhita.

5. The petitioner no. 2 is a lady and the mother of the deceased.

6. It is alleged that the dead body of the deceased was exhumed and her post-mortem was conducted and there was injury on skull and it is alleged that the petitioners and other family members participated in the killing of the deceased. The petitioner no. 2 is in custody since 14.02.2025.

7. Considering the fact that the petitioner no. 2 is a woman and the mother of the deceased, this application is allowed.

8. Let the petitioner no. 2, namely, Rashida Khatoon, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur/ concerned Court in connection with Vaishali P.S. Case No. 59 of 2025.
