JUSTICE ARUN KUMAR ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner is in custody in connection with Birpur (Balua Bazar) PS Case No. 180 of 2017 registered under Sections 363, 366A, 120B and 380 of the IPC.
The allegation in brief is that all the seven accused persons came after mid-night and kidnapped the daughters of the informant.
Learned Counsel for the petitioner submits that the girls were recovered in Delhi by the police after four days of the occurrence and in their statement recorded under Section 164 Cr.P.C. they have stated that they were kidnapped by some unknown persons while both of them were going to attend the call of nature and not from the house as disclosed in the FIR.
Patna High Court Cr.Misc. No.57709 of 2017 (2) dt.12-12-2017 Another co-accused has been admitted to bail by a coordinate Bench of this Court.
Having considered the said facts and circumstances, the petitioner, namely, Afroz Alam, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Birpur in connection with Birpur (Balua Bazar) PS Case No. 180 of 2017.
