The petitioner has filed the instant application for modification of the order dated 18.11.2022, whereby while granting bail to the petitioner in connection with Bahera P.S. Case No. 248 of 2022, the petitioner was directed to surrender in the Court below within a period of four weeks. It is submitted by learned counsel for the petitioner that petitioner is poor and and he could not manage Rs. 20,000/- to deposit to concerned DLSA and due to this reason he could not file bail bond within stipulated time .
Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.57425 of 2023(3) dt.25-08-2023 2/2 taking into consideration the submissions made on behalf of the petitioner and the contents of the modification application, the Court is inclined to allow the prayer of the petitioner. The order dated 18.11.2022 passed in Cr. Misc. No. 60219 of 2022 is modified and the time granted to the petitioner in the said order to surrender in the learned Court below is extended by a further period of four weeks from today. The remaining part of the order shall remain unchanged.
