The petitioner is languishing in custody since 07.09.2018 in connection with Rajepur P.S. Case No.16 of 2014 registered for the offences punishable under Section 395 of the Indian Penal Code.
Prosecution case as per the FIR is to the effect that on 30.01.2014, dacoity was committed in the house of the informant leading to the registration of the FIR against 15-20 unknown persons. It is alleged that the name of the petitioner sprang up on the confessional statement of Awdhesh Paswan. It is submitted by learned counsel for the petitioner that the petitioner has not been put on T.I. parade. However, learned APP after going through the case
Patna High Court Cr.Misc. No.74927 of 2018(3) dt.24-01-2019 2/2 diary has submitted that the petitioner has been made accused in similar nature of the case as statement to the effect has been made in para No.03 of the application, though he is on bail in all three cases.
Considering the fact that the petitioner has remained in custody for more than four months but has not been put on T.I.P., let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari, East Champaran in connection with Rajepur P.S. Case No.16 of 2014.
