JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2019 Petitioner seeks bail in connection with Ghoghardiha P.S. Case No. 54 of 2017, S.T. No. 99 of 2019, registered for the offence under Section 394 of IPC.

Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 26.11.2018 passed in Criminal Misc. No.65880 of 2018 with liberty to the petitioner to renew his prayer for bail after framing of the charge.

Allegation against the petitioner is of snatching of jewelry from the informant. Petitioner is not named in the F.I.R and he is accused in ten other cases.

Submission of learned counsel for the petitioner is that though he is not named in the F.I.R. but he has been given liberty to move after framing of the charge. He is in custody for

Patna High Court CR. MISC. No.41688 of 2019(2) dt.11-07-2019 2/2 about a year and other accused persons have already been granted bail in this case.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Jhanjharpur, District Madhubani in connection with Ghoghardiha P.S. Case No. 54 of 2017, S.T. No. 99 of 2019, with condition that bailors should be the close relative, having sufficient properties within the jurisdiction of Civil Court, Madhubani and further condition that he is to appear as and when required by the trial court, otherwise, his bail bonds shall be cancelled. With the above observations, this application is allowed.
