The petitioners have preferred this application for grant of regular bail in a case registered under sections 363, 366A and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons including the two petitioners herein are stated to have kidnapped the minor daughter of the informant.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. It is submitted that the daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. which is Annexure-2 to the petition. She has stated her

Patna High Court CR. MISC. No.54118 of 2021(2) dt.04-04-2022 2/2 age to be 20 years and has stated therein that she married with the petitioner no.1 out of her own volition. Learned counsel for the petitioners further referring to paragraph no. 10 of the petition submits that the petitioner no.1 admits to the marriage of the petitioner no.1 with the daughter of the informant. The petitioners are in custody since 15.7.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the statement of the daughter of the informant under section 164 Cr.P.C. together with the petitioners having remained in custody for over 8 months, the Court directs the two petitioners to be enlarged on bail in connection with Baunsi P.S. Case no. 290 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka.
