Petitioner seeks bail in a case registered for the offences punishable under Sections 353, 307, 429, 414, 216 of the Indian Penal Code and Section 25(1-b)a, 26, 27 and 35 of the Arms Act.
The petitioner is not named in the FIR and similarly situated co-accused, namely, Ram Babu Prasad has already been allowed bail by a Coordinate Bench of this Court vide order dated 17.11.2017 passed in Cr. Misc. No. 54972 of 2017. The petitioner has also stated on oath that he has got no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.58322 of 2017 (2) dt.12-12-2017 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kalyanpur Police Station Case No. 157 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
