JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Chousa PS Case No. 32 of 2016 registered under Section 394 of the IPC. Submission is that the FIR is against unknown and except disclosure of the name of the petitioner by another co-accused Sant Lal Singh in his confessional statement there is is no other material against the petitioner. Though the labourers claimed to have identified the miscreants but the petitioner was not put on TIP. Charge-sheet has been submitted and besides this no incriminating material has been recovered from the petitioner.

Having considered the said facts and circumstances, the petitioner, namely, Sanjay Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Udakishunganj, District Madhepura in connection with Chousa PS Case No. 32 of 2016.
