Petitioner seeks bail in a case registered under Sections 302, 120B, 307, 325, 341, 323, 34 of Indian Penal Code. It is submitted by the petitioner's counsel that specific allegation of assault is upon Bhorik Yadav and at best, petitioner was the member of the unlawful assembly. It is further submitted that other co-accused, similarly situated to the petitioner, have been allowed anticipatory bail by this Court in Cr Misc No 46045 of 2017 and Cr Misc No 55720 of 2017. Petitioner, who is having no criminal antecedent, is in custody since 11.08.2017.

Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail

Patna High Court Cr.Misc. No.748 of 2018 (2) dt.12-01-2018 2/2 on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Danapur, Patna in Bikram Police Station Case No 145 of 2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
