2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30 (a) of the Bihar Prohibition and Excise Act, registered in connection with Kateya P.S. Case No. 162 of 2024.

3. As per prosecution case, there has been recovery of total 198 liters of country-made liquor from two motorcycles and the petitioner was sat on one of the motorcycles.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner has no concern either with the seized motorcycles or with the alleged recovery of liquor. No

Patna High Court CR. MISC. No.48645 of 2024(2) dt.11-07-2024 2/2 incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 05.05.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIII-cum-Spl. Judge-Excise-I, Gopalganj in connection with Kateya P.S. Case No. 162 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
