The petitioner seeks bail in connection with Gaurichak P.S. Case No. 300/2016 dated 17.12.2016 instituted for the offences under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code.

The son of the informant is alleged to have been assaulted by as many as eight accused persons including the petitioner. The informant has not seen the occurrence and has only given hearsay information regarding the assault of her son. The victim was admitted in P.M.C.H. on 10.12.2016 for his treatment, but from the impugned order, it appears that he has been discharged on 09.01.2017.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.57060 of 2017 (2) dt.06-12-2017 2/2 there is no specific allegation against the petitioner and that the informant is not an eye-witness to the occurrence. The petitioner is in custody since 03.05.2017 and he has been made accused in only one case apart from the present case, reference of which has been made in para 3 of the petition, and in that case also, he is on bail. Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City in connection with Gaurichak P.S. Case No. 300/2016.
