====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 25-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Sessions Trial No. 157 of 2018 arising out of Gamharia P.S. Case No. 81 of 2018 instituted for the offence under Section(s) 341, 323, 324, 325, 307 and 504/34 of the Indian Penal Code pending in the court of learned Sessions Judge, Madhepura.
It is alleged by the informant in the Fard-e-beyan that petitioner along with other accused persons as named in the Fard-e-beyan forcibly took possession of purchased land of the informant by establishing idol of Mahabir ji. The informant raised protest then this petitioner and other co-accused persons armed with deadly weapons brutally assaulted the informant on his head, shoulder, hand etc. The informant was taken to Police
Patna High Court Cr.Misc. No.74967 of 2018(4) dt.25-02-2019 2/2 Station from where he was referred to Sadar Hospital. He was then referred to PMCH in serious condition.
Case diary has been received.
Learned A.P.P. after looking into the case diary has submitted that eight injuries have been sustained by the informant on vital part of his body. The injuries No. 6 and 7 were grievous in nature. The Sessions Judge has mentioned in the impugned order that out of 8 injuries, four were on the vital part of his body. The injury No. 6 and 7 were grievous in nature.
Therefore, looking into the serious nature of allegation against the petitioner, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer of the petitioner for grant of bail stands rejected.
