JUSTICE SANJAY PRIYA ORAL ORDER 07-02-2018 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this Court vide order dated 16.03.2017 passed in Cr. Misc. 5650 of 2017 with liberty to the petitioner to renew his prayer for bail after six months if no substantive progress is made in the trial. Report has been called for from the court below which has been received. From the report it appears that charge has been framed on 11.04.2017 but not a single witness has been examined in the case.
It has been submitted that petitioner is in custody since 12.09.2016. It has further been submitted that other co-accused persons have been granted bail by this Hon'ble Court vide orders dated 3.3.2015, 29.04.2015 and 13.05.2015 passed in Cr. Misc.
Patna High Court Cr.Misc. No.2092 of 2018 (3) dt.07-02-2018 2/2 45982 of 2014, 1133 of 2015 and 11540 of 2015 respectively. Those orders have been enclosed as Annexure-3 series. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Munger, in connection with Sessions Trial No. 36 of 2017 arising out of Kharagpur P.S. Case No. 152 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner.
The petitioner will cooperate in conclusion of the trial and he will remain present on each and every date of trial till disposal of the case. In the event of default of two consecutive dates, his bail bonds will be liable to be cancelled. (Sanjay Priya, J) S.Ali/- U T
