Petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. Informant in his written complaint has alleged that he was on day patrolling duty and at about 11:15 am when he reached near Balaji X-ray Ultrasound, he saw one person standing with PASSION pro Motorcycle. On seeing police party one person tried to flee away but was apprehended who disclosed his name as Banti Kumar (petitioner) and when he was asked about the motorcycle he said that he has purchased the theft motorcycle but the did not disclosed the name of the person from whom he purchased the motorcycle. Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case on mere
Patna High Court CR. MISC. No.55768 of 2021(2) dt.29-03-2022 2/2 suspicion. Petitioner is neither concerned with the motorcycle nor he is the owner of the motorcycle. Nothing has been recovered from the possession of petitioner. Petitioner has got no criminal antecedent and is in custody since 16.07.2021. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Laheri P.S. Case No. 296 of 2021 dated 15.07.2021, G.R. No. 3888 of 2021, with following conditions:-
(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.
(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
