JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 23-08-2018 After some arguments on the issues raised in the instant writ petition regarding the petitioner having been placed in the scale which was detrimental to his interest and came into existence after grant of promotion under notification dated 14.6.2003, learned counsel for the petitioner submits that the petitioner would file a representation before the respondents raising his claim for being granted the benefits attached to the post of Superintendent of Jail on which post he claims to have worked and discharged the duties. Submission is made with reference to the provisions contained in Rule 58 read with Rule 103 of the Bihar Service Code.
Without expressing any opinion on the merits of the
Patna High Court CWJC No.7800 of 2014 dt.23-08-2018 2/2 claim, the petitioner is granted liberty to raise the aforesaid claim before respondent authorities with details of his posting within a period of four weeks from today. If such application is filed, respondent authorities would be obliged to consider the claim as per law expeditiously by a reasoned and speaking order. (Madhuresh Prasad, J) Shashi.
