Petitioners are apprehending their arrest in connection with Agiaon Bazar P.S.Case No.148/18 dated 30.12.2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 379, 447, 452, 406, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioners and other accused persons are said to have entered into the house of the informant, assaulted her and others causing injury to them and also taken away the golden chain and Rs.25,000/-.
Submission of the learned counsel for the petitioners is
Patna High Court CR. MISC. No.46629 of 2019(2) dt.29-07-2019 2/2 that the petitioner no.1 has also lodged a case against the informant and others making allegation of firing on the petitioner no.1 and others and also empty cartridges were handed over to the police and the seizure list of the present case shows that the seizure list has been prepared prior to lodging of the written report and the witnesses on the seizure list are the petitioner nos. 2 and 3 and no specific allegation has been attributed against any of the petitioners. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJMVII, Bhojpur at Ara in connection with Agiaon Bazar P.S.Case No.148 of 2018 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
