The petitioner seeks bail in connection with Sessions Trial No.179 of 2021 arising out of Dinara (Bhanas) P. S. Case No.224 of 2018, instituted for the offences under Sections 395 and 412 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.06.2021, charge-sheet has been submitted in the case and has antecedent of one case under the Excise Act.

Allegation is of looting silver ornaments worth 01 kg. along with Rs.8,000/- and keys of the shop etc. as detailed in the F.I.R. by four unknown criminals. It is further alleged that the informant can identify the criminals, who committed the occurrence.

The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.55765 of 2021(2) dt.22-02-2022 2/2 F.I.R. was against unknown. The name of the petitioner came in the confessional statement of co-accused. Nothing was recovered from his possession, nor the petitioner was put on T. I. Parade, despite informant in the F.I.R. alleging that he could have identified the accused, who participated in the occurrence. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, his name came in the confessional statement of co-accused and not put on T. I. Parade, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-XI, Rohtas at Sasaram in connection with Sessions Trial No.179 of 2021 arising out of Dinara (Bhanas) P. S. Case No.224 of 2018.

The application stands allowed.
