JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Naubatpur P.S. Case No. 503 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story as per FIR is that while son, wife and daughter of informant were returning 8-10 miscreants fired, causing injury to son of the informant, who succumbed to the injuries and wife of informant has identified the petitioner and other accused persons.

Submission of learned counsel for the petitioner is that there was land dispute between the parties from before and as such he has been implicated in this case and only one injury was found on the person of deceased during postmortem. Heard learned APP, who has opposed the prayer for

No.42004 of 2019(3) dt.27-09-2019 2/2 anticipatory bail of the petitioner stating that apart from allegation he has criminal antecedent also and he is accused in one more case under Section 302 and other sections of IPC. In view of allegation as well as criminal antecedent, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Anticipatory bail granted to him by order dated 10.7.2019 is recalled. He may surrender and pray for regular bail.

This application is, accordingly, dismissed.
