The petitioner seeks bail in Dehri Nagar (Dalmianagar) P.S. Case No. 553/2018, instituted for offences under Section(s) 304(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is husband of deceased. He was present at the place of occurrence when police arrived, which shows his bonafide. Mere suspicion has been raised by the informant, which is found mentioned in column 8 of para 2 of case diary. There is no eyewitness of the occurrence. The death has occurred due to suffocation caused by strangulation.
Learned counsel for the petitioner has submitted that in the instant case petitioner along with his sister has been made accused but the police on the same day exonerated the sister of petitioner.

She was tortured in her Sasural for demand of dowry. The informant got information on 17.06.2018 that his daughter has died in her Sasural. The informant has alleged that the petitioner along with his sister Indu Devi have killed his daughter by putting rope around her neck. Re-statement of informant has been recorded in para 3 of case diary. Statement of independent witnesses has been recorded in para 4 and 5 of case diary. Mere suspicion has been raised against this petitioner.
Petitioner is in custody since 18.06.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Dehri Nagar (Dalmianagar) P.S. Case No. 553/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
