2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 351(2), 3(5) of the B.N.S.

3. The learned counsel for the petitioner after some argument seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 2, Ajay Patel.

4. Permisson is accorded.

5. It is next submitted that petitioner no. 1 has antecedent of three cases and petitioner no. 3, 4 and 5 are persons with clean antecedent. The learned counsel submits that informant alleges that accused persons came to his door and Heera assaulted him by rod causing injury on head, then Mangal assaulted him by lathi on thigh thereafter Ajay assaulted by rod causing injury on back, while Arun assaulted by rod on shoulder causing fracture of rib, thereafter Golu and Himanshu assaulted by Labeda over the leg and knee of the informant. On alarm the villagers gathered and the injured were taken to the hospital. The learned counsel submits that the petitioners and informant are neighbours and they are having dispute relating to land for which a title suit is also pending adjudication in between the parties.

It is next submitted that from side of the petitioner's Shikarpur P.S. Case No. 168 of 2025 has been instituted against the informant and his side, it is fairly submitted that injury of the injured on head has been opined to be grievous but then the said injury is alleged to have been caused by Heera who is not a petitioner in the instant case.

6. Learned A.P.P. opposes the anticipatory bail application.

7. Considering the submissions made by the learned

No.43143 of 2025(3) dt.04-09-2025 3/3 counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Bettiah, West Champarn in connection with Shikarpur P.S. Case No. 176 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.

8. The application stands allowed.
