The petitioner is in custody in connection with Karakat P.S. Case No. 196 of 2013 for the offenses under Sections 406, 409, 420 and 34 of the Indian Penal Code. The allegation against the petitioner is that he has illegally encashed Rs. 1 lac from the account of MANREGA Scheme, Gram Panchayat Budhawal, District-Rohtas. Learned counsel for the petitioner submits that for the same transaction 2 FIRs were lodged and in the first case the petitioner has been granted anticipatory bail. The petitioner is in custody since 09.08.2018. Counsel submits that the petitioner is ready to deposit Rs. 1 lac in two installments. Considering the aforesaid, let the petitioner, above
Patna High Court Cr.Misc. No.76207 of 2018(3) dt.29-01-2019 2/2 named, be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, District-Rohtas in connection with Karakat P.S. Case No. 196 of 2013, subject to the condition that petitioner shall deposit Rs. 50,000/- at the time of release and rest amount of Rs. 50,000/- within a further period of two months.
In the event of deposit of the aforesaid total amount of Rs. 1 lac, the court below shall make the provisional bail absolute.
